    2. Information We Collect

    Information you give us

    We collect information you choose to provide, including through our Contact, Find Your Horse, Transport Quote, Submit a Horse, and Horse Inquiry forms, our chat widget, and direct communications. Depending on how you interact with us, this may include:

    • Contact information: name, email address, phone number, mailing or pickup/delivery address, and preferred contact method.
    • Horse buyer information: riding discipline, experience level, budget range, preferences for a horse (for example, age, size, breed, temperament, level of training), and timeline.
    • Horse seller and listing information: details about a horse you submit, such as name, age, breed, height, discipline, training history, competition record, health or soundness information you choose to disclose, asking price, location, photos, and videos.
    • Transport information: origin and destination locations, dates, number of horses, horse details relevant to safe transport, and special handling needs.
    • Communications: the content of messages, chat conversations, emails, text messages, and call notes, and any other information you include in them.
    • Transaction information: information needed to provide quotes, invoices, or services. If you pay us, payment card or bank details may be collected and processed by a third-party payment processor rather than stored by us directly.

    Please do not submit sensitive personal information (such as Social Security numbers, health information about yourself, or financial account passwords) through our forms or chat.

    Information collected automatically

    When you visit the Site, we and our service providers may automatically collect certain information, including:

    • IP address, browser type, device type, operating system, and general location (such as city or region) derived from IP address;
    • pages viewed, links clicked, referring website, time spent on pages, and dates and times of visits; and
    • information collected through cookies, pixels, and similar technologies (see Section 6).

    Information from other sources

    We may receive information about you from third parties, such as a person who refers you to us, a horse seller or buyer involved in a transaction with you, advertising or social media platforms (if you interact with our pages or ads), and publicly available sources.

    3. How We Use Information

    We use the information we collect to:

    • respond to inquiries and requests, including horse inquiries, matching requests, and transport quote requests;
    • match buyers with suitable horses and evaluate horses submitted for listing or sale;
    • prepare quotes, estimates, agreements, invoices, and schedules;
    • coordinate training, delivery, and transport services;
    • communicate with you by phone, email, chat, and (with your consent where required) text message;
    • send marketing communications about horses, services, events, and education, subject to your choices described in Section 5;
    • operate, maintain, secure, and improve the Site and our Services;
    • understand how visitors use the Site and measure the effectiveness of our marketing;
    • detect, prevent, and address fraud, abuse, security incidents, and technical problems;
    • comply with legal obligations, enforce our agreements and Terms of Use, and protect our rights, property, and safety and those of others (including horses in our care); and
    • for any other purpose we describe to you when we collect the information, or with your consent.

    4. How We Share Information

    We do not sell your personal information for money. We share information only as described below:

    • Service providers. We use third-party vendors to operate our business, such as website hosting, customer relationship management (CRM), email and text messaging delivery, chat, scheduling, analytics, payment processing, and cloud storage. Our Site and lead management run on the GoHighLevel platform, and information you submit through our forms, chat, and messaging tools is stored and processed in that CRM. Service providers may use your information only as needed to provide services to us.
    • Transaction participants. To carry out a horse sale, purchase, matching, training, or transport request you initiate, we may share relevant information with the other party (for example, a seller or buyer), trainers, barns, veterinarians performing a pre-purchase examination you request, farriers, haulers, or other professionals involved. Horse listing information you submit may be shown to prospective buyers.
    • Legal requirements and protection. We may disclose information if we believe in good faith that doing so is required by law, subpoena, court order, or other legal process, or is necessary to protect the rights, property, or safety of LoForti Equestrian, our customers, the public, or any animal.
    • Business transfers. If we are involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, information may be transferred as part of that transaction, subject to this Privacy Policy or a policy at least as protective.
    • With your consent. We may share information for other purposes with your direction or consent.

    We may also share de-identified or aggregated information that does not reasonably identify you.

    Mobile information and SMS consent are not shared with third parties or affiliates for their own marketing or promotional purposes. Text messaging opt-in data and consent will not be sold, rented, or shared with any third party except service providers that help us deliver messages.

    5. Text Messages (SMS), Email, and Your Choices

    Text messaging program

    LoForti Equestrian may offer text messaging for (a) transactional or informational messages, such as responses to your inquiries, quote follow-up, appointment and scheduling updates, transport status and arrival updates, and account or service notices; and (b) marketing messages, such as new horse availability, promotions, and event or education announcements.

    • Consent. By providing your mobile number and checking an opt-in box, replying to a message, or otherwise affirmatively agreeing to receive texts from us, you consent to receive text messages from LoForti Equestrian LLC at that number, including messages sent using automated technology. We will obtain your separate, express written consent before sending marketing text messages where required by law. Consent to receive marketing texts is not a condition of purchasing any goods or services.
    • Frequency. Message frequency varies based on your inquiries and activity.
    • Costs. Message and data rates may apply, according to your mobile carrier plan.
    • Opt out. You can opt out at any time by replying STOP to any text message from us. After you reply STOP, we will send one confirmation message and then stop sending texts to that number, except as permitted by law. You may also opt out by contacting us using the information in Section 13.
    • Help. Reply HELP to any text message for assistance, or contact us at (757) 844-5111 or vincent@lofortiequestrian.com.
    • Carriers. Mobile carriers are not liable for delayed or undelivered messages.
    • Your number. You agree to provide only a mobile number that you own or are authorized to use, and to notify us promptly if you change or give up that number.

    Email

    You may unsubscribe from marketing emails at any time by clicking the "unsubscribe" link in any marketing email or by contacting us. Even if you opt out of marketing messages, we may still send you non-promotional messages related to an inquiry, quote, transaction, or service you requested.

    Phone calls

    If you do not want to receive marketing calls from us, tell us during a call or contact us, and we will add your number to our internal do-not-call list.

    6. Cookies, Analytics, and Similar Technologies

    The Site and our service providers may use cookies, pixels, web beacons, and similar technologies to keep the Site working, remember preferences, operate forms and chat, understand Site traffic and usage, and measure and improve our marketing. These may include analytics tools (such as Google Analytics) and advertising or social media pixels (such as from Meta or Google), if and when we use them. These third parties may collect information about your activity on the Site and across other websites over time.

    Your choices. Most browsers let you block or delete cookies through their settings. Blocking cookies may cause some Site features (such as forms or chat) not to work properly. You can learn more about opting out of Google Analytics at https://tools.google.com/dlpage/gaoptout and about interest-based advertising at https://optout.aboutads.info. Some browsers offer a "Do Not Track" setting; because there is no uniform standard for these signals, the Site does not currently respond to them. Where required by applicable law, we will honor recognized opt-out preference signals, such as Global Privacy Control.

    7. Children's Privacy

    The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us and we will take reasonable steps to delete it. Inquiries regarding horses or lessons for minors should be submitted by a parent or legal guardian.

    8. Data Retention

    We keep personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to respond to inquiries, provide Services, maintain business and transaction records, resolve disputes, enforce our agreements, and comply with legal, tax, and accounting obligations. When information is no longer needed, we will delete it or de-identify it, or, if that is not possible (for example, because it is stored in backups), we will securely store it and isolate it from further use until deletion is possible.

    9. Security

    We use reasonable administrative, technical, and physical measures designed to protect personal information. However, no website, internet transmission, email, text message, or storage system is completely secure, and we cannot guarantee the security of any information you send to us. You provide information at your own risk. Please do not send sensitive information through forms, chat, email, or text.

    10. Your Privacy Rights

    Requests available to everyone

    Regardless of where you live, you may contact us to ask us to access, correct, or delete personal information we hold about you, or to stop sending you marketing communications. We will consider and respond to requests as required by applicable law and as reasonably practicable. We may keep certain information where we need it to complete a transaction, comply with law, resolve disputes, or enforce our agreements.

    State privacy rights (including Virginia and California)

    Several U.S. states, including Virginia (under the Virginia Consumer Data Protection Act) and California (under the California Consumer Privacy Act, as amended), give residents certain rights over their personal information, such as the right to know or access, correct, delete, and obtain a copy of personal information, and the right to opt out of the sale of personal information, "sharing" for cross-context behavioral advertising, or targeted advertising. These laws apply only to businesses that meet certain thresholds, and LoForti Equestrian may not be subject to some or all of them. Where a state privacy law applies to us and to you, we will honor the rights it provides.

    Where applicable:

    • We will need to verify your identity before responding, which may require you to confirm information we already have about you.
    • You may use an authorized agent to submit a request, subject to verification of the agent's authority.
    • We will not discriminate against you for exercising your privacy rights.
    • If we deny your request, you may appeal by replying to our decision or emailing us with the subject line "Privacy Appeal." If you are a Virginia resident and disagree with the outcome of an appeal, you may contact the Virginia Attorney General.

    Nevada residents

    We do not sell covered information as defined under Nevada law. Nevada residents may submit a request regarding sales by contacting us.

    11. Third-Party Links and Platforms

    The Site may link to or embed content from third-party websites and platforms (such as social media, video hosting, maps, payment, or scheduling tools). We are not responsible for the privacy practices of those third parties. Your use of them is governed by their own privacy policies.

    12. Changes to This Privacy Policy

    We may update this Privacy Policy from time to time. When we do, we will post the updated version on the Site and revise the "Last Updated" date above. If we make material changes, we may provide additional notice as required by law. Your continued use of the Site or Services after an update is posted means the updated Privacy Policy applies to information collected afterward.
